1. Acceptance of Terms

By accessing or using the SimpliLeads website and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

SimpliLeads, LLC provides outbound marketing services including human cold calling, AI voice agent campaigns, and SMS outreach for real estate professionals. Services are provided on a month-to-month basis unless otherwise specified in a separate agreement.

3. Client Responsibilities

You agree to:

Provide accurate information for campaign setup and lead targeting
Ensure you have the legal right to contact individuals on lists you provide
Comply with all applicable federal, state, and local laws regarding telemarketing and electronic communications
Respond to escalated leads and campaign feedback in a timely manner

4. Compliance

SimpliLeads maintains compliance with the Telephone Consumer Protection Act (TCPA), state Do Not Call regulations, and 10DLC requirements for SMS. We scrub all lists against federal and state DNC registries. However, you are ultimately responsible for ensuring your marketing activities comply with applicable laws.

5. Data Ownership

You retain full ownership of all leads, recordings, transcripts, and campaign data generated through our services. Upon termination of services, we will provide all data in a standard export format upon request.

6. Payment Terms

Fees are billed monthly in advance for subscription plans. Usage-based charges (per-call, per-message) are billed monthly in arrears. Payment is due within 15 days of invoice. We reserve the right to suspend services for accounts more than 30 days past due.

7. Termination

Either party may terminate services with 30 days written notice. There are no early termination fees. Upon termination, we will complete any in-progress campaigns through their natural end and provide final reporting.

8. Limitation of Liability

SimpliLeads provides outbound services on a best-effort basis. We do not guarantee specific results, lead volumes, or conversion rates. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

9. Disclaimer

Services are provided “as is” without warranties of any kind, express or implied. We do not warrant that services will be uninterrupted or error-free.

10. Governing Law

These terms are governed by the laws of the State in which SimpliLeads, LLC is organized. Any disputes shall be resolved through binding arbitration.
